Supreme Court upholds stay of execution for Florida man

TALLAHASSEE, Florida (Reuters) - The Supreme Court on Tuesday upheld a last-minute federal appeals court ruling granting a stay of execution to a mentally ill Florida man convicted of killing eight people, including two teenagers, during the 1970s.

John Errol Ferguson, 64, had been scheduled to be executed around 6 p.m. EDT (2200 GMT) but his lawyers filed a flurry of appeals late Tuesday arguing he should not be put to death because he is mentally insane.

The ruling by the 11th U.S. Circuit of Appeals establishes a schedule for additional briefs to be filed in Ferguson's case by November 6.

Ferguson, who has been on death row for 34 years, was convicted of first-degree murder and sentenced to death in 1978 for a pair of killing sprees.

In July 1977, he fatally shot six people execution-style during a drug-related home robbery in a northern Miami suburb. Six months later, he killed two teenagers after they left a church meeting.

State psychiatrists and other medical professionals have diagnosed Ferguson as a paranoid schizophrenic with a long history of mental illness, according to his defense team.

Defense attorney Christopher Handman has said Ferguson considers himself the "Prince of God" and does not understand the death penalty and why it had been imposed.

"It is impossible to fathom that the state can constitutionally put to death a man who thinks he is the 'Prince of God' and who believes he has a destiny of being the right hand of God and returning to purify earth after the state tries to kill him," Handman said in a statement earlier this month.

Courts, however, have repeatedly rejected the claims.

On Monday, a federal appeals court rejected a new attempt by Ferguson's lawyers to postpone the execution, overturning an order by a south Florida U.S. District Court judge that the execution be delayed.

In early September, Florida Governor Rick Scott signed Ferguson's death warrant, but a few weeks later delayed the execution while a team of physicians met to decide whether Ferguson is mentally competent.

After a 90-minute examination and brief consultation earlier this month, a panel of psychiatrists determined that Ferguson was sane. A state circuit judge agreed in a ruling.

Posing as a utility company worker, Ferguson entered the home of Margaret Wooden, 24, on July 27, 1977 in the Miami suburb of Carol City. He pulled a gun, tied her up and called two accomplices into the home to search for drugs and money.

Six of Wooden's friends arrived at the house soon after and were tied up. Her boyfriend, Michael Miller, 24, also turned up. Six of the victims, including Miller, were shot to death. Wooden and another person escaped.

Ferguson was also found guilty of the abduction and killing of two 17-year-old Miami high school students.

According to court records, Ferguson abducted Belinda Worley and her boyfriend, Brian Glenfeldt, after they left a social event at a church on January 8, 1978.

Their bodies were found the next day in a nearby wooded area. Glenfeldt was shot in the head, chest and arm. Worley was found in dense brush with a gunshot to the back of the head. An autopsy revealed she had been raped.

Orphaned stars linger in dark matter haloes

Outcast stars stripped away by galaxy mergers may be trapped in the cocoons of dark matter that surround galaxies. If so, these stars would explain seemingly random smatterings of light in the infrared sky, which should illuminate studies of how the first galaxies formed and grew.

The universe is permeated by faint infrared light called the cosmic infrared background radiation, thought to be a collective glow emitted by all the stars and galaxies in the universe. This splotchy haze contains strange fluctuations that can't be explained by known sources.

Previous research hinted that the odd pattern might be caused by the very first stars and galaxies in the universe or the light of nearby dwarf galaxies that are too faint to resolve. But that would mean the universe spawned many more galaxies than we can detect, which would create turmoil for current models of how the cosmos has evolved.

Now, a new infrared map from NASA's Spitzer Space Telescope shows that unseen galaxies are not the culprits. When the intensity of light from the mysterious splotches is measured against that of known galaxies, it simply doesn't match, says Matthew Ashby, an astrophysicist at Harvard University who is on the study team.

The team instead found that Spitzer's map fits nicely with theories that there should be stars embedded in dark matter haloes. Observations suggest that the visible matter in galaxies is wrapped in much bigger envelopes of mysterious mass, which seems to hold the galaxies together. As galaxies merge, so do their dark matter haloes.

During these violent collisions, most stars and gas sink toward the middle of the growing galaxy. But streams of stars also get ripped from their homes by gravitational forces, creating what are called tidal tails.

According to theory, some of these stars may settle in the newly swollen dark matter haloes, which are so large that the stars would seem to be adrift in intergalactic space. Fluctuations in the infrared background could be the faint light from these isolated stars, says Ashby.

Team member Edward L. Wright notes that more work is needed to confirm the idea. The new research looked at a larger area of sky than ever before, but Spitzer's sensitivity is limited. When the James Webb Space Telescope is completed sometime in 2018, its advanced infrared eye should be able to get a more detailed picture of the faint galaxies in the early universe, and perhaps expose the spattering of lights in the dark spaces between galaxies.

Breast Cancer in Men

Many men don?t know it, but they can get breast cancer.

The most recent American Cancer Society estimates in U.S. men show nearly 2,200 new cases of invasive breast cancer in men this year. More than 400 men will die from the disease.

Missy Burkett is the breast nurse specialist at the Breast Health Center at Athens Regional Medical Center and said in her career she personally has only worked with one man diagnosed with breast cancer.

?The man had a palpable breast mass, or lump, and went to his doctor, who said he needed a mammogram and an ultrasound,? she said. ?This patient had a biopsy done that came back as cancer, and his initial reaction was surprise; eyes-wide-big surprised. He wasn?t expecting a diagnosis of breast cancer because he thought that just happened to women.?

Once he knew the problem, he went into ?let?s fix it? mode and told the doctors to do what they needed to do to get rid of it, Burkett said.

?He had a great attitude. He didn?t go into shock,? she recalled. ?Some men will go into major shock and will go through the same emotions that women do, but the shock a man would go through is always more severe than a woman?s because women always know there?s the possibility they could get breast cancer.?

The man Burkett worked with did very well in his treatment and currently is living his normal life.

Breast cancer is 100 times less common among men than women.

For men, the lifetime risk of getting breast cancer is about one in 1,000.

The number of breast cancer cases in men relative to the population has been fairly stable during the last 30 years.

Ashley Woodall, breast health educator at St. Mary?s Health Care System, has helped two male patients diagnosed with breast cancer in her career.

?The male breast cancer patients I have worked with have seemed to have a sense of embarrassment,? she said. ?There also is much disappointment and slight anger.?

To help her patients, Woodall offered as much emotional support as possible and tried not to make them feel different just because they were men.

?I was able to follow them through the whole process from imaging to biopsy, to diagnosis, to surgical referral, to the day of surgery and beyond,? she said. ?I offered them a manual on breast cancer in men, and on the day of surgery, I presented each male patient with a breast cancer bag, which included information, breast cancer magnets, pens, lapel pins, chapstick, a massage and a masculine breast cancer survivor comfort pillow. I called to check on the patients after surgery and gave them my contact information in case they needed any support in the future.?

Men typically discover they have breast cancer after they find a lump or have breast swelling or nipple discharge, nipple inversion, sores on their nipple or the areola (the darker colored ring around the nipple), soreness or enlarged lymph nodes under the arm.

?When men experience any of these (symptoms), it?s important that they go to the doctor right away to have it evaluated, but there are a lot of men that don?t understand that breast cancer can occur in men and will ignore the symptoms,? Burkett said. ?The longer they ignore it, the further the cancer will progress.?

Usually by the time men go to the doctor to have a lump checked, their cancer is at a more advanced stage than would be found in a woman, who are more apt to immediately see a doctor.

?It?s not masculine to have breast cancer, and they feel like it?s not macho to have something going on with their breasts,? Burkett said. ?What they need to realize is that they don?t need to be macho about this. If you have a problem or find something new in your breast, you need to admit it and go see a doctor and have an examination.?

The main difference between breast cancer in men and women is that men usually develop ductal carcinoma, a cancer that forms inside a milk duct.

The cancer treatments for men and women are similar, but when it comes to the surgery, women often have the option of having a lumpectomy.

Doctors typically perform a modified radical mastectomy on a man to remove all of the breast tissue and the nipple, but leave the chest wall muscle.

Woodall and Burkett suggest that men do self breast exams, especially if they have a history of breast cancer in their family.

If the only relatives affected by breast cancer were women, men still need to take the threat of breast cancer seriously.

Uncovering fabulous homes in a new city is always tricky, and my recent trip to Brisbane would have been rather fruitless had it not been for the generous assistance of a few very helpful people! Melbourne gallerist Sophie Gannon was particularly amazing ? she pulled out some serious detective skills, uncovering a number of unique homes and open-minded homeowners(!!) for me to approach. ?The one which seemed most fitting for this special week of Brisbane highlights is the incredible home of celebrated artist Michael Zavros, art curator Alison Kubler, and their kids,?Phoebe (7), Olympia (5) and Leonidas (18 months).

The phrase ?power couple? is perhaps a little dramatic, but it certainly springs to mind when trying to describe Michael and Alison! ?I get the impression they?re basically like the prom king and queen of Brisbane?s fine art scene. ?Michael is one of Australia?s leading contemporary artists, he has been the recipient of many awards for his AMAZING photorealistic drawings and paintings, including the Doug Moran National Portrait Prize in 2010, and?the inaugural Bulgari Art Award this year ? an $80,000 award which results in a painting acquisition for the Art Gallery of NSW. ?Alongside his incredible drawings and paintings, Michael also?creates intricately detailed bronze sculptures. ?Alison has equally impressive art world credentials ? she is is Associate Curator at the University of Queensland Art Museum, and runs her own art consulting business. (Let?s not forget these people also have three young children!)

The Zavros family live and work in this sprawling four bedroom property, where they?ve been based for just over five years. ?The home is actually in Chandler, around 30 minutes out of central Brisbane, on a generous 8 acre block which also incorporates a purpose built studio for Michael, swimming pool, tennis court and chicken house. ?Whilst the Zavros? home itself is still waiting for the ?big? renovation, extensive work has been done to two large industrial sheds on the grounds, to create Michael?s studio and a self contained guest house.

It?s clear Michael and Alison are avid collectors of many special things ? despite the presence of three very energetic young kids, their home certainly feels museum-like, full of valuable treasures! ??It?s an unusual mix of antiques and artworks? says Michael. ??We have a Bill Henson work that we love, we seem to have a penchant for chairs ? more chairs than people to sit in them. We also love our many Chesterfields, probably because they are all about sitting and relaxing, drinking wine and watching good telly. They are our sitting happy places!?

Not surprisingly, given their backgrounds, many of Michael and Alison?s dearest friends are artists, and most of the artworks you see here are swaps or gifts, and hold great sentimental value. ??Curiously, when gathered together, they all seem to be about portraiture? says Michael of the collection. ?Highlights include?works by Shaun Gladwell, Bill Henson and Susan Norrie.

Michael and Alison love the serenity of living outside of the city on a generous block ? ?It?s good to not hear your neighbours sneeze? says Michael. ?We love that the kids can throw on their boots and just be outdoors all day. ?At night wallabies bound about outside the bedroom and we have seen several koalas up close. Nature abounds!?

Massive thanks to Michael and Alison for sharing their eclectic home with us today, and to Alison for lots of amazing introductions and other Brisbane tip offs!

(AP) ? President Barack Obama has been wearing a pink wristband in recognition of breast cancer awareness month and his challenger, Mitt Romney, donned a pink ribbon on his shirt during a factory stop in Ohio.

The symbolic gestures are part of a determined competition in the campaign's closing weeks for suburban and working women who could help determine the winner in a series of toss-up states.

Women have emerged as the pivotal voting bloc in the aftermath of the second presidential debate, where Obama and Romney sparred over contraceptives and pay inequality and Romney spoke about reviewing "binders full of women" as governor when he sought to diversify his Massachusetts administration.

Some national polls suggest Obama's longstanding edge with female voters is narrowing, prompting both sides to make an all-out blitz for women.

At the heart of the debate, which is playing out in the suburbs of northern Virginia and in several swing states, is this question: What will most motivate women in the 2012 election?

Romney's pitch is heavily focused on economic issues ? his campaign contends that the vast majority of women will respond to pocketbook issues like paying for gasoline or groceries, the need for more take-home pay and how the federal debt might affect their children.

Obama has emphasized a mix of economic and social issues, warning that Romney's vow to repeal the Obamacare health law would hurt women and the Republican would fail to protect abortion rights.

Shirley Jackson, an 82-year-old Republican from Vienna, Va., said she continues to support Romney but is worried about how women perceive him. Jackson said she recently facilitated a discussion about the election at her local Red Hat Society meeting and was struck by how many women in the group said they were turned off by Romney's opposition to abortion rights.

"He has lost a tremendous amount of support among women because of this decision," Jackson said.

Democrats say Romney's views on women's health should be a deal-breaker. Melissa Skelton, 41, a stay-at-home mom from Vienna, said women's health has overshadowed other issues for multitudes of women ? and would help the president.

"I'd rather live with a president who struggles with the economy but cares about people," she said.

Romney's campaign is mindful that it does not need to win a majority of women because it maintains a healthy lead among men. But campaign officials say they could severely weaken the president's re-election chances by slicing into the 13-point margin Obama had with women voters in 2008 and picking off support in swing states where women form a majority of the electorate.

Obama's team, meanwhile, is trying to take advantage of the president's personal favorability among women and undermine those voters' trust in Romney.

Ads have highlighted Romney's opposition to federal funding for Planned Parenthood and his shifting views on abortion rights, which he supported in Massachusetts but has opposed during his two presidential bids. The Obama ads end with this tagline: "Women need to know the real Mitt Romney." Abortion-themed ads have been on the rise in recent weeks across the political spectrum, more than tripling in the number of occurrences since mid-September, according to Kantar Media Intelligence.

The campaigns are competing for women in several key suburban markets ? including northern Virginia, the Denver suburbs, central Florida and Cleveland's suburbs ? while simultaneously appealing to unmarried women and those with blue-collar backgrounds who have been more vulnerable to the slow economic recovery. Obama won about 70 percent of unmarried women and carried about 60 percent of suburban women in 2008, setting a high bar for the president's campaign.

The intense effort to reach female voters has grown as national polls have shown cracks in Obama's support among women. Four years ago, Obama and Republican rival John McCain essentially split men in 2008 but polls have shown Romney with a double-digit lead among males this time.

"The big gender gap I'm looking at right now is Obama's male gender gap because those men seem pretty cemented in," said Republican pollster Kellyanne Conway, who served as an adviser to Newt Gingrich's presidential bid. "Whereas there's a fair amount of women who remain fluid, either completely undecided or soft in their support for either Obama or Romney."

Romney has sought to distance himself from statements he made on abortion and contraceptives during the Republican primaries while driving home that his economic plan would create jobs for women and their families. Romney's wife, Ann, has been a key surrogate for her husband, vouching for him before female audiences.

In TV ads, Romney offers a moderate image. In one ad, a woman says that Romney "thinks abortion should be an option in cases of rape, incest or to save a mother's life" but says she's "more concerned about the debt our children will be left with." Another spot features women who served under Romney. "He totally gets working women," says Ellen Roy Herzfelder, Romney's former environmental affairs secretary.

Obama reminds voters that the first law he signed was the Lilly Ledbetter Fair Pay Act, which prevents restrictions on workers filing lawsuits over pay inequity. Romney has not taken a position on the bill but said he wouldn't repeal it.

At rallies, the president routinely talks about the women in his life: how his grandmother watched men she trained get promoted over her, how education lifted his wife, Michelle, from a modest upbringing and why it wouldn't be fair if his two daughters earned less than their male counterparts when they eventually join the workforce.

Computer viruses 'rampant' on hospital medical devices, say ...

(NaturalNews) All the technological advancements taking place within the medical system today are supposed to make it easier and more efficient for doctors, nurses, and hospital staff to monitor and assist patients. But according to a number of medical device experts that spoke at a recent meeting of the National Institute of Standards and Technology's Security & Privacy Advisory Board, hospital medical devices are often so infected with viruses and malware that their reliability and effectiveness is questionable at best.

Just like personal computers that are constantly at risk of becoming infected with viruses, spyware, malware, and other harmful files, medical devices that compound intravenous drugs and nutrition, for instance, or that monitor women with high-risk pregnancies, are also at risk. Because of their proprietary nature and narrowly-specified license and approval guidelines, medical devices are actually more at risk of catching computer viruses because they are often outdated, unprotected, and unable to be modified or upgraded.

"Conventional malware is rampant in hospitals because of medical devices using unpatched operating systems," says Kevin Fu, an expert in medical device security and computer scientist at the University of Michigan and the University of Massachusetts, Amherst. "There's little recourse for hospitals when a manufacturer refuses to allow OS updates or security patches."

This refusal by manufacturers to maintain hospital equipment with the latest anti-virus and malware protection software is largely a result of fears over how the U.S. Food and Drug Administration (FDA) will treat updated products within the regulatory paradigm. There is much confusion, in other words, about how already approved and regulated medical devices are to be properly maintained and updated with respect to the law, which is putting patients at serious risk.

"We worry about situations where blood gas analyzers, compounders, radiology equipment, nuclear-medical delivery systems, could become compromised to where they can't be used, or they become compromised to the point where their values are adjusted without the software known," adds Mark Olson, Chief Information Security Officer at Beth Israel Deaconess Medical Center in Boston, which has seen its own share of infected medical equipment.

In many cases, hospitals routinely have to shut down certain medical devices for days at a time in order to get them cleaned up, as well as to ensure that they have not also infected the hospital's private intranet system. Once a particular machine is back in order, another one typically requires service as well, which creates a never-ending cycle of having to continually disinfect vital hospital equipment of potentially disastrous software bugs.

The FDA is reportedly in the process of reviewing how it handles software updates for approved medical devices, but the problem is expected to continue indefinitely until a comprehensive workaround is effectively implemented. In the meantime, patients will have to simply hope that technology staff are regularly monitoring medical devices to ensure proper functionality, and quickly addressing any problems that might arise.

The problem is also being exacerbated by clinicians who bring their own devices in to work, including tablet devices and smartphones that easily link up to the hospital network. Though it is often more convenient for doctors and nurses to use their own devices rather than official equipment, the risk of spreading technological viral infections increases as a result.

Movie Review: Paranormal Activity 4 is More Trick than Treat ...

A Nevada family plays host to a very odd six-year-old neighbor boy whose mother has suddenly been hospitalized in 'Paranormal Activity 4.'

A group of young unknown actors jumps into the 'Paranormal Activity' formula without a hitch. The long stretches of green night-cam footage manage to creep you out as you try to figure out if you just saw movement in the corner. And when something eventually flies across the screen, no matter how much you try to anticipate it, you jump.?

A neighborhood witches' coven plays into the proceedings, adding to the drama. In the end, as expected, all you really get is a whole bunch of jolts and scares. If you have seen any of the previous films, it's more of the same. This time around I was more tricked than treated.

The original 'Paranormal Activity' back in 2007 was fresh. But with this installment, the found-footage, evil-entity gimmick has grown stale. So the flick-o-meter gives 'Paranormal Activity 4' a three out of five. The premise seems a bit scatter brained and pointless?but because Halloween is upon us, it should do the trick of getting you in the mood for those things that go bump in the night.

Obama's Bundlers Include Former Republican Florida Gov. Charlie Crist, Gwen Stefani

The Obama campaign today voluntarily released a full list of its top campaign financiers, also known as bundlers. Combined, these 758 individuals are responsible for at least one fifth - or $180 million - of the more-than-$835 million raised by President Obama and Democrats for this election.

These wealthy donors each give the legal maximum to the campaign for the primary and general elections ($5,000) and to the Democratic National Committee ($30,800). They then get their well-placed friends and colleagues to do the same.

Supporters who collect $50,000 or more for Obama and Democrats earn the "bundler" classification.

Obama added 120 new bundlers to his list in the third quarter, July through September, including former Republican governor of Florida, Gov. Charlie Crist, former Secretary of State Madeleine Albright and singer Gwen Stefani, who raised more than half a million dollars, according to the Obama campaign.

The president also received elite fundraising support from 13 American bundlers who live overseas, collecting ex-pat cash in London, Paris, Geneva and Shanghai.

Here's the breakdown of Obama bundlers, as provided by the campaign:

172 bundlers at $50,000-$100,000 each

169 bundlers at $100,000-$200,000 each

181 bundlers at $200,000-$500,000 each

236 bundlers at $500,000+ each

It's important to note that Obama is the only candidate to voluntarily release the identities and contribution amounts of his bundlers. Republican presidential nominee Mitt Romney has not released comparable information, breaking with a precedent set by President George W. Bush and continued by the 2008 Republican presidential nominee, Sen. John McCain, R-Ariz., by keeping his top financiers secret.

NEW ORLEANS -- A study conducted by the American Academy of Pediatrics (AAP) has documented that boys in the U.S. are experiencing the onset of puberty six months to two years earlier than reported in previous research.

The study, "Secondary Sexual Characteristics in Boys: Data from the Pediatric Research in Office Settings Network," will be published in the November 2012 Pediatrics and published online Oct. 20 to coincide with the AAP National Conference & Exhibition in New Orleans. The trend toward earlier onset of puberty in girls is now generally accepted and supported by extensive research. Until now, little research was available on the age of onset of puberty in boys in contemporary times.

The study was designed and conducted through the AAP Pediatric Research in Office Settings (PROS) practice-based research network, a system of hundreds of pediatricians nationwide who contribute data to AAP-led scientific studies on children's health. A 1997 PROS study was the first large study to document earlier pubertal onset in US girls. For the study of pubertal characteristics in boys, 212 practitioners in 144 pediatric offices in 41 states recorded information on more than 4,100 boys.

This new research found that the observed mean ages of stage 2 genital and pubic hair growth, and early testicular enlargement standard indications of pubertal onset were six months to two years earlier than documented by data several decades earlier. Pediatricians recorded the earliest stage of puberty as occurring in non-Hispanic white boys at age 10.14 years; in non-Hispanic African-American boy at age 9.14 years, and in Hispanic boys at age 10.4.

Overall, African-American boys were more likely to start puberty earlier than white or Hispanic boys. Study authors say the causes and public health implications of an apparent shift toward a lower age of puberty onset for boys is unclear and warrants further research.

"Contemporary data on the ages of pubertal characteristics in U.S. boys from onset to maturity, lacking until now, are needed by pediatricians, public health scientists, and parents," said study author Marcia E. Herman-Giddens, DrPH. "Following changes in growth and development is an important part of assessing the health of the nation's children. I am grateful to the pediatricians and the boys who participated in this exciting study."

"All parents need to know whether their sons are maturing within the contemporary age range, but, until now, this has not been known for U.S. boys," said PROS Director Richard C. Wasserman, MD, MPH, FAAP. "The PROS study provides 21st century standards."

"The landmark PROS study of the 1990s provided contemporary data for girls' puberty," Dr. Wasserman said. "A study on boys puberty was a logical follow-up. Our pediatric endocrinologist colleagues now use the PROS puberty assessment training materials in their own studies and fellowship training."

Global Recession Ahead in 2013: Time to Get Out ... - Yahoo! Finance

U.S. growth has slowed to 1.3%. Greece and Spain are in recession and China's economy has lost momentum for seven consecutive quarters and is now growing at 7.4%. At the same time stocks continue to rally and the S&P 500 Index (GSPC) is trading near its year-to-date high.

Gary Shilling, president of A. Gary Shilling & Co., calls this the "grand disconnect." He tells The Daily Ticker, "Either the economies of the world have got to come to life and? rise to meet investor expectations or investors have got to come down to earth. The latter is more likely."

Shilling, whose firm analyzes the global economy and manages money, says "massive deleveraging" is the source of the slowdown in the global economy. It began three years ago and will likely continue for another five to seven years, driving the global economy into recession in 2013, Shilling says.

Monetary easing in the U.S., Europe and China is offsetting some of the impact of that deleveraging but the effect is limited, says Shilling. Otherwise the global economy would be stronger and the U.S. economy would not be as mixed. He says consumer spending and housing are gaining in the U.S. but exports are slowing along with capital spending in the industrial sector. He says a "hard landing" in China is likely and he's suspect of China's official economic stats. "Nobody really believes their numbers."

Investors seem to be a lot more optimistic. Shilling says they're banking on monetary easing in their "risk-on" trades: going long on stocks and commodities and shorting bonds and the dollar. He recommends the opposite. Stocks have outperformed Treasuries this year but longer term the opposite was true. If Shilling is correct, bonds will rule again.
