ATLANTA ? A former investigator with the city of Los Angeles says Atlanta police rejected his job application solely because he has HIV.
The 40-year-old man sued the city of Atlanta, and a federal appeals court is going to hear arguments in the case Wednesday. Police departments, gay rights groups and health organizations are closely watching the lawsuit.
Atlanta police say a doctor recommended not hiring the man because he posed a health threat to the public. They say they did not reject his application outright because he has HIV.
Police departments have gone to court over the issue before. The lawsuits have either been dismissed by judges who sided with the departments or they have been settled out of court, with those agreements being confidential.
